1.   Incorporation Of General Terms and Conditions, and Terms and Conditions for SingNet Service by Reference

1.1    The General Terms and Conditions, and the Terms and Conditions for SingNet Service shall be deemed to be incorporated by reference into this Agreement and shall apply mutatis mutandis in addition to the terms and conditions contained herein provided always that in the event of any conflict of inconsistency between or among the General Terms and Conditions, the Terms and Conditions for SingNet and the terms and conditions herein contained, the Terms and Conditions herein contained shall prevail.

2.   Definitions Of Terms

2.1    "Customer" shall mean the subscriber whose application for Fax Mail Service is accepted by SingTel.

2.2    "Service" shall mean a service offered by SingTel Fax Mail Service which is provided by SingTel through the Internet to enable SingNet Services customers to receive facsimile messages.

2.3    "SingTel" shall mean Singapore Telecommunications Limited.

3.   Period Of Subscription

3.1    The minimum period of subscription to the service should be one (1) calendar month otherwise specified by SingTel.

4.   Termination

4.1    Subject to anything to the contrary herein contained either party may terminate this Agreement by giving to the other party a written notice of not less than one (1) month;

4.2    This Agreement shall automatically terminate in the event that the SingNet Service Agreement is terminated for any reason whatsoever. In such an event, in addition to any other liabilities, the customer shall be liable to pay SingTel all amounts that would have been payable by the customer to SingTel had this Agreement not been terminated as aforesaid; or

4.3    In the event that the customer terminates this Agreement before the expiry of the minimum period of subscription for the service, the customer shall in addition to any other liability, be liable to pay SingTel the amounts due for the balance of the minimum period of subscription.

5.   Customer Responsibilities

5.1    The customer shall ensure that the Service shall be used solely for the reception of fax messages and not for any other purposes whatsoever.

6.   Indemnity

6.1    The customer shall indemnity and keep indemnified in full and at all times, SingTel against and in respect of all costs, expenses, claims, suits, proceedings or damages whatsoever and howsoever, arising out of or by reason of the use of the service by the customer.

6.2    SingTel shall not be liable for the contents of messages received or transmitted . In the event of any claims whatsoever, including but not the limited to claims for libel, slander or infringement of copyright or any intellectual property rights whatsoever, arising from any message transmitted or received or other claims arising out of any act or omission of the Customer his/its servants or agents against SingTel, and the customer shall indemnify and keep indemnified at all times SingTel in full in respect of all such claim(s) whatsoever.

7.   Disclaimer

7.1    SingTel shall not be liable whatsoever (whether in contract, tort or otherwise) for any liability, loss, cost or expense (including consequential, special or indirect loss/damage) for any loss, suspension or interruption of the service howsoever.
